No, it’s not a ‘fail’. When push came to shove, they were going to choose their rigid religious dogma (or some approximation thereof) over helping the poor and starving. A charity primarily interested in helping the poor would be willing to follow the law, even if it doesn’t necessarily fit in with their personal religious beliefs. Other companies and charities are not allowed to discriminate in that fashion. They were willing to give up their supposed cause because they didn’t want to include gay partners on their group health insurance (a negligible cost, to be honest, since large portions of the bill of any insurance involving domestic parters or spouses is footed by the employee, not the umbrella corporation the employee works for). If I’m going to donate money to an organization that tells me they’re going to use that money to help the homeless, then they better damn well do it. If they in turn use that money to run ad campaigns, threaten politicians and cities, persecute their own employees, and then threaten to take away services I donated money for, well, heck. That’s not money well spent on my part. I wouldn’t trust them with a dime. It shows where their priorities lie. Why would you give money to an organization with priorities that screwed up?

Hawaii has had a mandated health care insurance requirement for employers for nearly 40 years. We have lower premiums than most of the country and one of the highest coverage rates. It's not universal healthcare, but at 94% or so, it's pretty darn close. You are required to purchase healthcare because otherwise if you get ill or in an accident, WE all pay for you if you don't have resources. If I have to pay if you can't, why shouldn't you be required to purchase a minimal amount of healthcare?
And NO, it's not communism. Again, why should I pay for YOU when there is an alternative? Billions of the Stimulus Bill went to public hospitals in this country to pay the bills for uninsured patients so that the hospitals could stay open.
